Grass Valley Doctor Indicted on Drug Charges

A Grass Valley doctor who also has an office in Yuba City is under federal indictment for illegally distributing and dispensing oxycodone.  Assistant  U.S. Attorney Paul Hemesath is prosecuting the case.

According to court documents Dr. Capos,  who is 63 and resides in Granite Bay,  is also facing 5 counts of  distributing and dispensing oxycodone outside the usual course of professional medical practice and without legitimate medical purposes.

The indictment alleged Dr. Capos illegally dispensed 1,590    30-milligram oxycodone pills  during the   summer of 2012 .

This case is the product of an investigation by the DEA, the California Medical Board, and the California Attorney General’s Bureau of Medi-Cal Fraud and Elder Abuse.

If convicted, Capos faces a maximum  penalty of 20 years in prison and a $1 million fine. Any sentence, however, would be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines, which take into account a number of variables.  The charges are only allegations; the defendant is presumed innocent until and unless proven guilty beyond a reasonable doubt.

I can think of at least one more local dr whom this should happen to. Time to crack down on the initial dealer. The doctors who dispense with out reguardless to what the end out come is.
