Growers Seek Ordinance Modifications

With the first growing season under the new Nevada County Marijuana Ordinance completed as outdoor gardens have been harvested, the Americans for Safe Access-Nevada County organization is already planning on how to move forward with planning gardens next year. ASA-Nevada County Organizer, Patricia Smith, says the Nevada County Ordinance that went into effect in May of 2012 is completely inadequate and abuses patients rights to grow medicinal marijuana effectively.

Smith says the Nevada County Ordinance is much stricter than state law, and ASA-NC wants to Nevada county to be managed with the same requirements as the state.

Under the Nevada County Ordinance, it is not the number of plants per patient but the square footage of a garden that is causing concerns. The restrictive space allotment causes overcrowding of plants leading to growing issues.

In regards to indoor grows, Smith is completely baffled by the enforcement of the ordinance. She doesn’t see how an indoor grow, when done, properly is a nuisance to neighbors.

American’s for Safe Access-Nevada County has filed a case that is scheduled to be heard by Superior Court Judge Sean Dowling in May of 2013.
