Judge grants part of injunction medical marijuana backer sought

A Nevada County Superior Court judge Friday (July 27) blocked enforcement of part of the medical marijuana measure passed by the Board of Supervisors that prevents two or more individuals from different residences cultivating the plant on a single parcel. But Judge Sean Dowling in his decision on the injunction sought by the Nevada County chapter of Americans for Safe Access, a pro-medical marijuana group, did not block enforcement of other aspects of the county measure.

Regulations about the size and location of medical marijuana grows remain in place. Americans for Safe Access contended the county’s restrictions for marijuana grows left individuals with inadequate space. The judge’s ruling includes his statements that, “not every citizen embraces medical marijuana. Not every citizens wants a large medical marijuana grow next door.”
