Americans for Safe Access – Nevada County was in court Friday, represented by marijuana rights attorney Jeff Lake in a lawsuit to halt the county’s cannabis cultivation ordinance on behalf of collectives. But Judge Sean Dowling refused to issue a temporary restraining order saying information of the pending ordinance was available in a timely manor and so far no irreparable harm has been presented. ASA President Patricia Smith says in an e-mail they were expecting to lose this round, but are just warming up.
Assistant county Council Marcos Kropf responded to Smith’s comments as well as the Judges determination.
The next court date is set for June 26 at 9:00 am, in Nevada County Superior Court when Judge Dowling is expected to hear actual declarations from patients and cultivators of actual harm caused by the Ordinance.

I believe Judge Dowling is breaking a HIPPA law by requiring a patient to reveal their affliction.
