McCary is scheduled to be arraigned on December 28th, when a trial date may also be set. Newell says there’s always the possibility that the case could be settled before going to trial. 62-year-old Dennis McCary is also charged with being an accessory. Authorities say he fled the crime scene with the gun and tried to hide it.
