Case Dismissed Against County Marijuana Ordinance

Nevada County has prevailed in defending the Medical Marijuana Ordinance adopted last year that was challenged in a lawsuit brought by the pro medical marijuana group, Americans for Safe Access- Nevada County Chapter.   Nevada County Assistant County Counsel, Marcos Kropf explains the action taken this morning by Judge Sean Dowling in Superior Court in Nevada City.

By dismissing the case brought by Americans for Safe Access the court has in essence validated the legality of the county ordinance.
Marijuana Plants in containersAmerican’s for Safe Access Nevada County Chair Patricia Smith was anticipating their case to be thrown out  after the state high court earlier this month validated local jurisdictions legal right to manage medical marijuana through land use and zoning.

ASA Nevada County has indicated their next step will be to start a signature drive to place an initiative on the ballot to repeal the county medical marijuana ordinance.

I other ordinance related news, ASA-NC is holding a workshop with attorney Jeff Lake tomorrow at the North San Juan Senior Center beginning just after 2:00 PM that will cover how to remain in compliance with the Nevada County Ordinance.
