Drug Cases Dismissal Motion Officer Misconduct

A motion to dismiss charges in three drug cases against a man has been filed due to misconduct by a former Nevada County Sheriff’s detective. And that may also impact a number of other cases. The District Attorney’s office says former detective Mark Hollitz had an inappropriate relationship with an informant, and of using that person to set up another informant who refused to cooperate with the investigation. The motion also states that because of Hollitz’ actions, some 80 cases are now under review for possible dismissal. These three particular cases involved drug possession and sales charges against Joel Franks. A Nevada County Judge must still approved the dismissal motion, with a hearing scheduled on Monday.
