DUI Arrest in Lake of the Pines

A Lake of the Pines Security guard noticed a driver speeding in the area of Torrey Pines and Oro Valley Drive a little after two in the morning Saturday . CHP Officer Justin Barnthouse says when the security guard  stopped the driver it appeared he was under the influence and the security guard called a CHP officer to do an evaluation.

Driving is considered a privilege and not a right, but officer Barnthouse says  a Supreme Court ruling in  2013 upheld a decision that officers must get a warrant before forcing a suspect to undergo a blood test.

Officer Barnthouse says judges will typically take turns to handle calls for warrants during late night hours.
