Runner says the premise of the lawsuit is that the legislature approved the fee with only a majority vote, and it should have required two-thirds, because it is a tax. He hopes the lawsuit will get to court before the end of the year. There’s also pending legislation to abolish the fee, but Runner isn’t very confident that that legislation will pass. Runner says the fee is 152 dollars and 33 cents–about the same as it was last year…
This is the fourth year of the fee, which was passed in time of a state budget crisis.
