Gaines Says Governor Sidestepping Gann Limit

Californians could get their first state budget rebate checks since the mid-1980’s. But Nevada County’s State Senator says Governor Brown is standing in the way. Ted Gaines says the governor is attempting to sidestep the so-called Gann Limit. The Gann Limit, named after tax watchdog Paul Gann, was passed by voters in 1979 as Proposition 4. It caps government per-capita spending, adjusting for inflation and population growth, with any amount over that being rebated to taxpayers. Gaines is commenting on a recent report from the Legislative Analyst’s Office, which says Brown’s proposed budget wrongly excludes the $22 billion, that would go to schools. The report calls it “nowhere money” that violates the spirit of the law…

If the Legislature approves the exclusion of the money during the final vote on the state budget, the Legislative Analyst says the state would be highly vulnerable to a lawsuit.
