Lippiatt says a recent revision of a state law, known as the “Davis-Stirling Common Interest Development Act”, says homeowners associations can enact rules which are legally binding upon residents, as long as they don’t conflict with state or federal law. He declined to elaborate further regarding the basis of the legal challenge, prior to the hearing. The Lake Wildwood Association did not return a call for comment.
