The Chairperson for Americans for Safe Access Nevada County has filed a petition to change the wording on the ballot for Measure S. According to the petition, current ballot language for the measure does not comply with Elections Code and violates the fundamental principles of neutrality. Attorney Stephen Munkelt submitted the petition on behalf of ASA-NC Chair Patricia Smith.

Munkelt says that language on the ballot is taken from a resolution against Measure S submitted by a majority of county supervisors.

Munkelt also says the language in some cases is allegedly false or misleading.

According to the petiton, the ballot wording was confirmed by the County Counsel last week. Munkelt explains this is the appropriate route to address the perceived issue.

A hearing has been set for Wednesday morning. Ballots are scheduled to start mailing on October 6th.
The Elections Office had not returned calls prior to the story.
