The Nevada County District Attorney’s office has filed charges against YubaNet Co-founder and editor Pascale Fusshoeller in regards to her being pulled over after failing to stop at a stop sign in Nevada City on October 8th.

District Attorney Cliff Newell says originally Fusshoeller was charged with felony false impersonation by the arresting CHP Officer, but has now decided that charge was not warranted.

Fusshoeller who is a native of Luxembourg, had no prior criminal history. Because she used another person’s identity when she was booked into jail, Immigrations and Customs Enforcement was alerted that she had been in the country without a proper visa for the past 15 years. Last summer, when it became legal to do so, Pascale married her partner and U.S. citizen Susan Levitz. The couple were in the process of filing immigration papers to allow Pascale to remain legally in the U.S. when the arrest occurred. Newell says he doesn’t know how the misdemeanor charges might affect Pascal’s immigration status.

The next legal step for Fusshoeller will be arraignment November 18th on the misdemeanor and infraction charges.
