No Prosecution Of Truckee Vehicle Death

A Truckee man arrested nearly seven months ago in the DUI hit and run death of another man in the town will not be prosecuted. Police say the victim, 25-year-old Justin Ardagh, was, unbeknownst to 32-year-old Stephen Lally, sitting for a moment on the rear trunk lid of Lally’s vehicle. When Lally drove off, Ardagh was violently thrown to the ground, where he struck his head and died later. Lally left the scene but was located by police a short while later and arrested. But Nevada County District Attorney Jesse Wilson says no charges are being filed….

But Wilson indicates the incident wasn’t simply an accident…

Wilson also says Lally, once taken into custody, was cooperative with authorities. The victim and a group of friends had been standing in the roadway near an intersection, late on the night of April 14th. According to witnesses, Lally, considered a mutual friend of the group, had driven up to the group.
