McGrath says the truck that belonged to Lugo had been seen backed up to the river, below Parks Bar Bridge, with a 500 to 1000 gallon tank on a number of past occasions before a state warden was finally called out. He says Lugo has taken full responsibility for the theft, which is why the other man, who is from the Los Angeles area, is not being charged.
